Collaborative divorce

Each party will employ their own firm of lawyers in a collaborative divorce. After that, the parties and their counsel will sign a “Participation Agreement” committing to the collaborative divorce process. The parties will agree to engage in the process in good faith and to freely and publicly communicate information; the lawyers will be required to withdraw from representing their clients under the Participation Agreement.

Cooperative divorce

In a Cooperative Divorce, the lawyers and clients will agree to collaborate with one another, much as they would in a Collaborative Divorce although, there is one major difference; If the cooperative procedure fails and litigation is needed, the lawyers such as, family law solicitors in Parramatta are not obliged to sign an agreement obliging them to withdraw as counsel.
